Low-maintenance steps for a rented apartment leak

Checked 26 October 2026. General process research, not a finding of fault. No complaint or legal application has been filed.

Start with the landlord, not a government complaint

The least-effort route is one clear written defect notice to the contractual landlord. Ask them to arrange a check, deal with the source owner or building management, and restore the affected ceiling/wall. This is a practical recommendation: TBK 301 requires the landlord to keep the rented property fit for its agreed use; TBK 318 requires the tenant to report defects promptly. TBK 306 permits requesting cure within a reasonable time. These provisions do not make a notarial notice mandatory for every defect report.

If someone says the leak is repaired, first obtain one simple fact at a time: what was repaired, then when. A repair claim is not proof that the leak stopped. Old stains may remain after repair; a stain alone does not prove continuing leakage. Keep dated photos and any source/repair report. Avoid paying for repainting before the underlying condition is checked.

Suggested workflow: preserve the existing photos and correspondence; identify the landlord from the lease; send one short written request for inspection and a plan; review the reply once rather than sending daily reminders. Two working days for a written plan is a suggested coordination checkpoint, not a statutory repair deadline. Actual repair time must be reasonable for the defect and urgency. Do not wait where water or falling material creates an immediate hazard.

If that fails: mediation is the real legal escalation

Rental, condominium and neighbour-right disputes generally require mediation before a merits lawsuit under Law 6325 art 18/B. Mediation is a negotiation process, not an online tribunal that decides fault or orders a repair. Nobody must agree to settle. If the other side refuses or no agreement is reached, the final record supports the later court route.

Online submission has a signature barrier. UYAP's published service list places mediation applications under the additional functions for electronic-signature holders. A normal e-Devlet password can provide portal access, but is not proof of filing capability. The Ministry confirms online applications through Citizen and Lawyer Portals. If there is no existing e-signature, compare a courthouse mediation-bureau application with having an authorized lawyer file; do not buy a signature solely on the assumption that this is easier. Lawyer fees and any power-of-attorney costs are separate and unquoted.

Remote meetings are possible, not guaranteed. Agree with the appointed mediator how meetings, identification, interpretation and signatures will work. A lawyer can attend with specific mediation authority in the power of attorney. Do not assume a telephone discussion alone produces a binding settlement.

Foreign residents can be parties. The mediation law includes disputes with a foreign element. Official e-Devlet guidance permits foreigners with an issued foreigner identity number to obtain a password. End-to-end mediation submission on a particular foreign-resident account remains untested; mobile-signature support for this exact action is also unverified.

The cost trap: free filing does not mean free settlement

Application to the mediation bureau is free. In compulsory mediation, the Ministry funds the statutory first two hours when no agreement is reached; excess unsuccessful meeting time is normally shared unless agreed otherwise. State-funded fees can be allocated later as litigation costs.

Under the 2026 tariff art 7(7), a successful settlement carries a minimum total mediator fee of TRY 9,000, potentially higher. This is the total, not automatically the applicant's share. Fees are normally shared equally unless another allocation is agreed. Obtain the applicable calculation before agreeing. Lawyer, interpreter and court-annotation costs are separate and not priced here.

For the art-18/B disputes, the settlement needs the statutory court enforceability annotation. That and signature handling add work. A mediated agreement is therefore not automatically enforceable just because a phone call ended amicably. This is a fallback when ordinary coordination fails, not the lowest-maintenance first move.
